1. The agreement
These terms are an agreement between you and The Seidl Family LLC (“we”, “us”, “our”) for your use of the Intimacy app and the website at ourintimacy.app (together, “Intimacy”). By creating an account or using Intimacy, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Intimacy.
2. Eligibility
- You must be at least 18 years old (or the age of majority where you live, if higher) to use Intimacy.
- Intimacy is for two consenting adults in a relationship. You may pair only with a consenting adult partner who has chosen to share a space with you.
- You may not use Intimacy if you have been barred from it before, or if using it would break the law where you live.
3. Your account and recovery phrase
- Keep your password, your phone, and your 24-word recovery phrase secure. You are responsible for activity on your account.
- Your content is end-to-end encrypted with keys we never have. We cannot recover your data without your recovery phrase. If you lose both your recovery phrase and your password, your content is permanently unrecoverable, by you or by us.
- Give us an email address you can access, so we can reach you about your account and verify requests such as account deletion.
- Tell us promptly at hello@ourintimacy.app if you believe your account has been accessed without your permission.
4. Acceptable use
Intimacy is a private space built on trust between two people. When you use it, you agree that you will:
- only share content you have the right to share, and that your partner has agreed to receive;
- never share images or videos of anyone who has not consented to them being taken and shared, including private images of a former partner or anyone else;
- never upload, share or request any content involving a minor, including child sexual abuse material (CSAM). We have zero tolerance for this. We will remove the accounts involved and report it to the National Center for Missing & Exploited Children (NCMEC) and other authorities as required by law. See our Child Safety Standards;
- not use Intimacy to harass, threaten, pressure, coerce, stalk or monitor anyone;
- not upload or share anything illegal, or use Intimacy for any unlawful purpose;
- not try to break, probe, overload, reverse engineer or get around the security of Intimacy, or access accounts or data that aren't yours;
- not sell, resell or use Intimacy commercially.
5. Your content
Everything you add to Intimacy remains yours. You give us only the permission we need to store, encrypt, sync and deliver your encrypted content to you and your partner in order to run the service. Because it is end-to-end encrypted, we cannot view it.
Content you add to your shared space is visible to your partner. Either of you can delete any shared item, and deleting it removes it for both of you.
6. Encryption and enforcement
End-to-end encryption means we cannot see, scan or review your content. As a result, we rely on reports from users to learn about misuse. Report concerns in the app (More → Settings → Report a concern) or by email to hello@ourintimacy.app with the subject “Safety report”.
When we receive a credible report, we may take action based on the information available to us, including warning, suspending or deleting accounts, and reporting to law enforcement or NCMEC where required. Because we cannot decrypt content, we may need to act on the report itself and the account information we hold.
7. Unpairing and deletion
- Either partner can unpair at any time. Unpairing permanently deletes everything in your shared space, for both of you. This cannot be undone.
- Deleting your account deletes your account and, if you are paired, also unpairs you, with the same effect.
- Neither partner needs the other's permission to unpair or delete. Save anything you want to keep before you do.
See Delete your account for details.
8. Alpha software
Intimacy is currently in private alpha testing. Alpha software may contain bugs, may change significantly, and may occasionally be unavailable. Features may be added or removed. Please don't rely on Intimacy as the only copy of anything you can't afford to lose. Intimacy is free during the alpha. If we introduce paid features later, we'll tell you clearly before you're charged for anything.
9. Availability and changes to the service
We work to keep Intimacy running smoothly, but we don't promise that it will always be available, uninterrupted or error-free. We may change, suspend or discontinue any part of Intimacy. If we decide to shut Intimacy down entirely, we'll give you reasonable advance notice where we can, so you have time to save your content.
10. Shopping links
In the future, Wishes may include links to products in other stores. Some of those may be affiliate links, which means we could earn a small commission if you buy something. If we add them, we'll disclose it clearly. Purchases are between you and the store.
11. Termination
You can stop using Intimacy and delete your account at any time. We may suspend or terminate your account if you break these terms, if we are required to by law, or to protect you, your partner, other people or Intimacy. Where appropriate and lawful, we'll tell you why. Sections that by their nature should survive termination (such as disclaimers, limitation of liability and indemnity) will survive.
12. Disclaimers
Intimacy is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We can't control what someone does with content outside the app, for example by photographing a screen with another camera. Intimacy is not a substitute for professional advice, counseling or emergency services.
13. Limitation of liability
To the fullest extent the law allows, The Seidl Family LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, arising from or related to your use of Intimacy. Our total liability for any claim related to Intimacy is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not fully apply to you.
14. Indemnity
If you break these terms or the law, or violate someone else's rights, through your use of Intimacy, you agree to indemnify and hold harmless The Seidl Family LLC from claims, losses and expenses (including reasonable legal fees) that result, to the extent the law allows.
15. Governing law
These terms are governed by the laws of the state in which The Seidl Family LLC is organized, United States, without regard to conflict-of-law rules. If you live in a country whose consumer protection laws give you additional rights, nothing in these terms takes those rights away.
16. Changes to these terms
We may update these terms. We'll change the effective date above, and if a change is significant we'll let you know in the app or by email before it takes effect. If you keep using Intimacy after the change, you accept the updated terms.
